Why does personal liability insurance exist?

Under German law, anyone who unlawfully and culpably causes injury or loss to another person may be required to compensate them. The financial consequences of serious personal injury can continue for many years.

Personal liability insurance has two roles. It checks whether a claim for damages is justified and in what amount. It meets justified claims within the agreed cover and provides a legal defence against unfounded liability claims at its own expense.

The policy does not insure your own belongings. It covers your legal liability towards third parties and must therefore be distinguished from household contents, legal expenses and motor insurance.

What does it typically cover?

Benefits vary by policy. The policy schedule and conditions are always decisive.

  • Bodily injury, property damage and resulting financial loss
  • Liability as a pedestrian, cyclist or participant in private leisure activities
  • Depending on the policy, damage to rented premises, loss of keys and bad-debt cover
  • Depending on the policy, damage caused by children who are too young to be legally liable, or damage arising while helping friends or neighbours

Limits and conditions

  • Intentionally caused damage is not insured.
  • Your own losses and claims between co-insured people may be excluded.
  • Professional or business activity generally requires separate cover.
  • Motor vehicles, dogs, horses and certain property risks usually require separate policies.
  • Overall limits, deductibles and sublimits restrict the amount payable.

Who should review their cover?

The key issue is not age or occupation alone, but whether a person has their own cover or is effectively included in another policy.

Couples and families

Partners and children may be included depending on the policy. Names, household and education status must be reflected correctly.

Moving out, completing education, marriage, separation, a pet, property or self-employment can change the protection required.

A cyclist overlooks a pedestrian while turning. The pedestrian is injured and claims treatment costs, loss of earnings and other consequential losses. The insurer first examines liability and pays only to the extent that liability exists and the policy provides cover.
